Frais notaire

It is usually the seller’s Notary who draws up the deed. Nonetheless, don’t hesitate to ask your Notary for his/her assistance. He/she will help you in case of dispute and at no extra charge. Actually, when two Notaries are involved in the same transaction, they share the fees.

Nature of Notary fees

Only a portion of the fees actually correspond to the Notary’s own remuneration, the rest is collected by the tax authorities or linked to fees required for the transaction. Notary fees include :

  • The charge for services performed by the Notary called professional fees
  • The fees and taxes due to the Treasury. These are essentially registration fees called “duty on transfer for valuable consideration”. They include the commune tax, the cost of collection, the Departmental council’s registration fee, State duties.
  • The disbursements, which include all the expenses the Notary pays in advance on your behalf (payment to the Land Titles office, the Mortgage Registry, for the pre-emption right, the deed, the surveyor, etc.)

These are set by decree and vary according to the sale price. They are also subject to VAT at 19.6%.

Payment of fees

Notary fees are paid on the date the official deed is signed. However, the actual value of fees is not known until all formalities have been accomplished. This is therefore more explicitly a reserve for fees that is paid at the time of signing. When all formalities have been performed (about 6 months after signing), the Notary provides the buyer with a detailed list of all fees, and where applicable a refund of any residual fees.
